Worker Direct Hire Terms and Conditions

“Hire” shall mean the retention of a SnapShyft Contractor (Worker) to perform work outside of the SnapShyft Platform within twelve (12) months following a Business User’s last contact with a Contractor through engagements facilitated on the SnapShyft Platform by any officer, employee, representative, or anyone retained by any of the aforementioned. Should a SnapShyft Contractor (Worker) receive solicitations of a job offer or, general employment opportunity (position notwithstanding), to enter into an employer-employee relationship with a Business User, Worker shall promptly notify SnapShyft thereof.
ELIGIBLE MATCH BONUS
When such “hires” occur, Workers may become eligible to receive a “Match Bonus”. This bonus is based on confirmed and documented employment with a Business User, as indicated through regular reporting and updates provided by the Business User. During each of the first 6 months of confirmed employment, a Worker may receive up to $200 SnapShyft “Match Bonus”. Should.a worker cease to be employed by a Business User they must notify us in a timely manner. “Match Bonuses” will be paid within thirty (30) days after an employment confirmation has been received from a Business User. “Match Bonuses” earned are not transferable. “Match Bonuses” are paid ONLY to qualified workers that have been hired following the prescribed method (i.e. SnapShyft Direct Hire Program), and any deviation from adhering to SnapShyft terms and conditions, or policies will subsequently VOID any potential “Match Bonus” that may have been earned otherwise.
This offer (the “Match Bonus”), is made to you by SnapShyft (as defined in the SnapShyft Terms and Conditions). At any time, a Business User, or a Worker, may decide to terminate the employer-employee relationship with the other party. SnapShyft has no influence or control over such a termination. SnapShyft reserves the right, in its absolute discretion, to withdraw or to modify this “Match Bonus” Offer and/or the Direct Hire Terms and Conditions at any time without prior notice and with no liability.
UNILATERAL NON-CIRCUMVENTION
All Users (SnapShyft Contractors and Business Users) agree to refrain from contacting directly, initiating contact with, or attempting to conduct business, for the purposes of circumventing SnapShyft, with any Worker or Business User that originated by or through the SnapShyft platform or other means directly attributable to SnapShyft. Circumvention, which is here understood to mean a conducting of business between a Business User and any SnapShyft Contractor which could prevent SnapShyft from realizing a profit, fees, or other gains, carried out without explicit, written permission from SnapShyft. The burden of proof that circumvention did not take place falls on the Business User and SnapShyft Contractor(s) respectively.
CIRCUMVENTION PENALTY
Worker agrees to pay to SnapShyft any associated fees related to shifts that were not posted to the SnapShyft platform due to circumvention. A service interruption fee of $500 per unique Business User, and up to $1,500 in additional penalties will be owed, per unique Business User, based on the number of worked shifts for any Business User confirmed to have engaged in circumventing SnapShyft. Use of the SnapShyft Platform constitutes acceptance and willingness to pay these fees.
